Terms & Conditions

1. TERMINOLOGY
The following terms and conditions apply to all dealings between The Room and The Client.

2. QUOTATIONS AND PRICING
a. All quotes as stated, are valid for a period of thirty (30) days. Any quote outside this time is subject to a re-quote.
b. Price quoted is based on the original brief and project overview outlined in the investment schedule. If the project varies from the original brief, additional costs will be incurred at our hourly rate and added to the final invoice. The Client will be advised at the time of request if the task is “out of scope” of the original project quotation and given the option to proceed or decline the additional work UNLESS it is necessary to the completion of the project.
c. Shipping, couriers or postage and A3 colour printouts as required are not included.

3. DESIGN CREDIT AND USAGE
a. The Room retains the right to use the artwork and associated materials for the purpose of design competitions, future publications on design, educational purposes, marketing materials and our portfolio at our discretion.
b.The Client agrees to allow The Room to credit ourselves for design work on all websites we develop.

4. AUTHORS CORRECTIONS
a. 2 rounds of minor revisions to text and imagery (not design or layout) are included for client changes.
b.This process begins after The Client is supplied first PDF proof. Amendments outside of this are charged at our hourly rate of $110 ex GST. Please ask for clarification if uncertain as to what constitutes minor.
c.The Room makes every effort to suit The Client’s brief if The Client is not happy with the concepts provided and the amends do not fall within minor revisions to the project The Client can pay for further concepts to be developed at our standard hourly rate.

5. PAYMENT
a. Payment of accounts must be made in seven (7) days of receipt of invoice unless other terms have been agreed to prior.
b. 50% deposit is to be paid in full before a project can commence or be booked in our system. Invoice for deposit will be issued on acceptance of quote. Upon completion and project sign off final 50% payment  must be received prior to artwork release or website GO LIVE.

6. IMAGES
a. Some designs will require stock imagery that is available for purchase. Price will be quoted at time of project layout.
b. If The Client is to supply images to The Room it is required they be supplied in high res format, preferably as CMYK. The Room will charge at our hourly rate of $140 p/hr for any editing or image manipulation to images other than required for preparing print ready files.
c. The Room is not responsible for reproduction quality of The Client supplied images. Although, if image supplied is poor or unacceptable The Client will be advised at time.

7. FILE SUPPLY
a. The Client has the right to use the artwork produced only for the purpose of which it was commissioned. Intellectual Property and associated materials remain the property of The Room unless otherwise agreed.
b. Source files are not included in quotation but can be purchased and released on The Client’s request. Files will be released to The Client only when invoice for agreed sum of files is paid in full.

8. INCOMPLETE, CANCELLED OR POSTPONED PROJECTS
a. If The Room is contracted to provide a project and the project is cancelled, The Room reserves the right to demand payment and expenses for all work incurred to date.
b. The Room does not refund any monies for any cancelled projects.
c. If for any reason the project is put on hold, or the client fails to respond within ten (10) business days or more, a further invoice of 30% of project total will be issued. The remaining 20% balance will then be issued on project completion. All work will be 100% invoiced on completion.
d.If The Client puts a project on hold for two (2) months or more, the project balance will be invoiced in total. In the event the project exceeds a six (6) month or more period in the studio the project will be closed and balance invoiced. Any future requests will need to be re-quoted.

9. TURNAROUND TIMES
a. The Room will make every effort to meet requested turnaround times and deadlines. While all care is taken The Room will not be held liable for any costs resulting from late artwork or printing deadlines.

10. PRINTING
a. Whilst all care is taken The Room is not liable for any printing errors, using The Clients chosen printer, which cannot be overseen by The Room.
b. Trimming can vary from printer to printer. Text should not be placed within 3mm of any edge.
c. Please note that colour on projects may vary from screen to screen and on final product. Screen proofing is not indicative for colour of final output. Printed colours can vary from printer to printer, run to run due to the nature of the process.
d. Delivery of printed product is quoted as to one (1) address only.
e.Although we do our best to display product and ink colours as accurately as possible; due to the inconsistencies of various display monitors, the colour you see on your screen may not be a totally accurate reproduction of the actual product and ink colours. Screen images are intended as a guide only and should not be regarded as absolutely correct. When placing your order, you are acknowledging this fact and waive any claim of dissatisfaction due to colour.

11. APPROVAL PROCESS
a. Approval is required for all projects via our approval form’s or in writing prior to work being released.
b. Please advise who will be signing off on conceptual and final artwork                                              

12. WEB DEVELOPMENT
a. The Room offers a warranty on functionality of websites we build for a period of thirty (30) days from date of handover. Handover is deemed as from when the client is given access to the CMS or the site is deployed or whichever comes first. Phone support after handover will be billed at our hourly rate of $160 p/hr. Website training is available at our hourly rate. Please request a quote if training is required.
b. Services in the warranty period do not include enhancements to the project or other services outside of scope. Support service means commercially reasonable technical support and assistance to maintain and update the deliverable including correcting and any errors or deficiencies. Request for additional support will be billed on a time and materials basis at our standard hourly rate of $160 p/hr.
c. Your hosting activation means we will upload your URL to your nominated hosting provider. Pointing of Domains to your hosting provider needs to be done prior and is the responsibility of The Client at time of registration

13. LEGALS
a. The laws of the State of Queensland shall apply and any legal proceedings commenced by any part of this agreement shall be issued out of and heard in the relevant court at Brisbane.
b. The Room reserves the right to peruse late or overdue payment. That except by force of law, the parties acknowledge that The Room gives no warranty whether express or implied for the services and associate materials. In no event shall The Room be liable for any
